Kathleen recently received a consultation request from someone in southern California. The person was the estate representative of a probate case and was concerned the person they hired to list the home was not upholding their fiduciary duties. They wanted to speak to someone about it.
Kathleen called the person to get more information. The fact pattern was detailed and complicated. She then called her real estate attorney to discuss the matter. Kathleen is careful not to interfere with a contract. Given the person had signed a purchase agreement with a real estate agent, Kathleen had concerns about discussing with the caller because doing so may be perceived as tortious interference with a contract.
The attorney informed Kathleen that it is not a tort to talk with someone who is under contract if there is no economic advantage. If you are talking with someone for the purpose of gaining a sale, that is interference. In other words, she would have benefited from listing the home for sale herself. That was clearly not the case given the home was not in Santa Clara County.
Knowing the circumstances, Kathleen recommended that the estate representative consult with an attorney. She believed if the listing agent received a call or a letter from the attorney stating the legal remedy, the issue would be resolved. Kathleen is not an attorney. However, as a real estate broker, her opinion of what the listing agent did was not professional, unethical, and downright shady.
