As a Santa Clara County CPRES, Certified Probate Real Estate Specialist, Kathleen Daniels receives calls from people in various counties across the State of California and some from states other than California.
The help that people seek ranges from wanting to hire Kathleen to list a probate home in Santa Clara County to legal help which Kathleen cannot directly provide because she is not licensed to practice law. She can however as a CPRES refer people to local real estate and/or probate attorneys to get the help they need.
A common thread with most callers is that they lack the funds to hire an attorney. As many times as people ask the same “legal” question repeatedly, CPRES, Kathleen’s response is the same. She is not an attorney and cannot give legal advice. Kathleen senses frustration with some callers because they believe she knows the answer to their questions. Even if that were true, she would not cross that line. The best help CPRES, Kathleen Daniels can give is to recommend an attorney well-versed in the subject matter. She is committed to helping all callers in every possible way.
When people call CPRES, Kathleen Daniels to list a probate or trust estate home, money is not a factor because there is no fee for a consultation. She is paid for listing and marketing the home when escrow closes.
Kathleen recently received a consultation request from someone in southern California. The person was the estate representative of a probate case and was concerned the person they hired to list the home was not upholding their fiduciary duties. They wanted to speak to someone about it.
Kathleen called the person to get more information. The fact pattern was detailed and complicated. She then called her real estate attorney to discuss the matter. Kathleen is careful not to interfere with a contract. Given the person had signed a purchase agreement with a real estate agent, Kathleen had concerns about discussing with the caller because doing so may be perceived as tortious interference with a contract.
The attorney informed Kathleen that it is not a tort to talk with someone who is under contract if there is no economic advantage. If you are talking with someone for the purpose of gaining a sale, that is interference. In other words, she would have benefited from listing the home for sale herself. That was clearly not the case given the home was not in Santa Clara County.
Knowing the circumstances, Kathleen recommended that the estate representative consult with an attorney. She believed if the listing agent received a call or a letter from the attorney stating the legal remedy, the issue would be resolved. Kathleen is not an attorney. However, as a real estate broker, her opinion of what the listing agent did was not professional, unethical, and downright shady.
Several days later the caller sent CPRES, Kathleen Daniels an email. The contents of the email, in part, are shared below. While clients rave about Kathleen Daniels and the service she provides, it is rare for someone who is not a client, to express such gratitude.
“Thank you very much. From the bottom of my heart, I want you to know I appreciate you taking the time out of your busy life to consult with me. I know we had a lengthy conversation, which was unpaid for you. So, the fact that you took your time to speak with me and help me as thoroughly as possible, explain things in detail, and make sure I did not have any further questions just showed me the type of genuine, kind, compassionate, and helpful caring person that you are. It is rare to find a person possessing such characteristics these days, so to be able to speak with you and see that you are one of those people was a true blessing. In other words, thank you, sincerely, Kathleen. I truly appreciated every bit of your help. I hope your profession, career, and life are very prosperous. Because you deserve every bit of it. You are a very kind soul.
Thank you for sharing this contact information. I appreciate it a lot. I hope you have a GREAT and WONDERFUL rest of your day, week, month, year, and life. I will forever recommend you and your business to all of my family out in California as well as anyone else I can refer you to.”
