Probate sale activity in Santa Clara County Q-1 2024.  This probate in real estate sales activity report is published by Kathleen Daniels, an Independent Real Estate Broker, a Certified Probate Real Estate Specialist (CPRES), and Certified in Professional Fiduciary Management for Trustees specializing in probate and trusts real estate. Probate and Conservatorship matters fall under the jurisdiction of the Santa Clara County Superior Court, probate division.  A legal process must be followed when selling a house in probate or buying a probate house.


 

Probate Sale Activity January 2024

The probate sale activity in Santa Clara County includes statistical data from January 1, 2024, through January 31, 2024, extracted from MLS Listings “MLS” as of February 1, 2024.

The data for January, February, and March include single-family homes, planned unit developments (“PUDs”) condominiums, and townhouse-style homes that may be probate property with HOA disclosure obligations and may not include “off-market” sales. An “off-market” sale is when the property is sold without listing on the Multiple Listing Service.

The breakdown of the January 2024 sales activity is as follows:

  •  7 active listings
    • 5 probate homes
    • 2 selling property held in living trust after death
    • 5 single family homes
    • 2 condominiums
  • 6 pending sales (under contract)
    • 6 probate

Many probate sale homes sell at premium prices

The highest-priced home sold in January 2024 was in Cupertino 95014

A 3 bedroom, 1 bathroom, 1,008 square feet on a 9,800 sq. ft. lot.  It was listed in early November 2023. The list price was $2,750,000. After 8 days on the market, it went under contract. The sale closed on January 5th. The final sale price was $3,035,000.  It was an all-cash purchase.

The lowest-priced home sold in October 2023 was in San Jose 95135.

A 1 bedroom, 1 bathroom, 947 square feet condominium. It was listed in early August. The list price was $459,000. After 26 days on the market, it went under contract. The final sale price was $450,000.  It was a cash purchase.

 


 

Probate Sale Activity February 2024

The probate sale activity in Santa Clara County includes statistical data from February 1, 2024, through February 29, 2024, extracted from MLS Listings “MLS” as of March 1, 2024.

The breakdown of the February 2024 sales activity is as follows:

  •  11 active listings
    • 9 probate houses for sale
    • 2 selling property held in living trust after death
    • 7 single family homes
    • 2 condominiums
  • 5 pending sales (under contract)
    • 3 probate

Probate sale may be subject to the overbid process and court confirmationThe highest-priced home sold in February 2024 was in  San Jose 95132.

A  3 bedroom, 2 bathroom, 1,067 square feet on a 5,663 sq. ft. lot. It was listed in early early December. After 48 days on the market, it went under contract. The list price was $1,050,000.  The final sale price was $1,350,000. The buyer had conventional financing.

The lowest-priced home sold in February 2024 was in Santa Clara 95050.

A 1 bedroom, 1 bathroom, 716 square feet condominium. It was listed in early December. The list price was $549,888. After 329 days on the market, it went under contract. The final sale price was $550,000. The buyer had conventional financing.

 


 

Probate Sale Activity March 2024

The probate sale activity in Santa Clara County includes statistical data from March 1, 2024, through March 31, 2024, extracted from MLS Listings “MLS” as of April  1, 2024.

The breakdown of the March 2024 sales activity is as follows:

The primary has 5 bedrooms, 4 bathrooms, and 4,336 square feet of living space. There is a separate 2 bedroom, 1 bathroom, 800 square feet ADU.  The properties reside on over 9 acres and are considered a fixer-upper. The list price was $2,499,000.  After 33 days on the market, it went under contract. The final sale price was $2,175,000. The buyer had conventional financing.

The lowest-priced home sold in March 2024 was in San Jose 95118.

A 2 bedroom, 1 bathroom, 810 square feet condominium.  The list price was $549,000.  After 9 days on the market, it went under contract. Court confirmation was required. The final sale price was $585,000. The buyer had conventional financing.
