Probate sale activity in Santa Clara County Q-4 2023.  This probate in real estate sales activity report is published by Kathleen Daniels, an Independent Real Estate Broker and Certified Probate Real Estate Specialist (CPRES) specializing in probate real estate. Probate and Conservatorship matters fall under the jurisdiction of the Santa Clara County Superior Court, probate division.  There is a legal process that must be followed when selling a house in probate or buying a probate house.


 

Probate Sale Activity October 2023

The probate sale activity in Santa Clara County includes statistical data from October 1, 2023, through October 31, 2023, extracted from MLS Listings “MLS” as of November 1, 2023.

The data for October, November, and December include single-family homes, planned unit developments (“PUDs”) condominiums, and townhouse-style homes that may be probate property with HOA disclosure obligations and may not include “off-market” sales. An “off-market” sale is when the property is sold without listing on the Multiple Listing Service.

The breakdown of the October 2023 sales activity is as follows:

  •  9 active listings
    • 8 probate homes for sale
    • 1 selling property held in living trust after death
    • 6 single-family homes
    • 2 townhouse
    • 1 condominium
  • 5 pending sales (under contract)
    • 4 probate

Many probate sale homes sell at premium prices

The highest-priced home sold in October 2023 was in San Jose 95125.

A 3 bedroom, 1 bathroom, 1,349 square feet on a 6,487 sq. ft. lot.  It was listed in the middle of September. The list price was $1,298,888. After 7 days on the market, it went under contract. The sale closed on October 23rd. The final sale price was $1,365,000. There were two offers. The buyer had conventional financing.

The lowest-priced home sold in October 2023 was in San Jose 95135.

A 1 bedroom, 1 bathroom, 947 square feet condominium. It was listed in early August. The list price was $459,000. After 26 days on the market, it went under contract. The final sale price was $450,000.  It was a cash purchase.

 


 

Probate Sale Activity November 2023

The probate sale activity in Santa Clara County includes statistical data from November 1, 2023, through November  30, 2023, extracted from MLS Listings “MLS” as of December 1, 2023.

The breakdown of the November 2023 sales activity is as follows:

  •  4 active listings
    • 2 probate houses for sale
    • 1 selling property held in living trust after death
    • 2 single-family homes
    • 1 condominium
  • 8 pending sales (under contract)
    • 8 probate
    • 7 single family homes
    • 1 townhouse
  • 5 sold homes

Probate sale may be subject to the overbid process and court confirmationThe highest-priced home sold in November 2023 was in Sunnyvale 94087.

A  4 bedroom, 2 bathroom, 1,834 square feet on a 9,246 sq. ft. lot. It was listed in early early October. After 9 days on the market, it went under contract. The list price was $2,385,000.  The final sale price was $2,560,000. The buyer had conventional financing.

The lowest-priced home sold in November 2023 was in San Jose 95121.

A 2 bedroom, 1.5 bathroom, 988 square feet condominium. It was listed on October 10th. The list price was $525,000. After 35 days on the market, it went under contract. The final sale price was $551,000. It was a cash purchase.

 


 

Probate Sale Activity December 2023

The probate sale activity in Santa Clara County includes statistical data from December 1, 2023, through December 31, 2023, extracted from MLS Listings “MLS” as of January 1, 2024.

The breakdown of the December 2023 sales activity is as follows:

    • 2 selling property held in living trust after death
    • 5 single family homes

  • 4 pending sales (under contract)

A  3 bedroom, 2 bathroom, 2,801 square feet on a 215,290 sq. ft. lot. The list price was $2,099,000.  After 37 days on the market, it went under contract. The final sale price was $2,099,000. The buyer had conventional financing.

The lowest-priced home sold in December 2023 was in San Jose 95112.

A 2 bedroom, 1 bathroom, 780 square feet on a 6,029 sq. ft. lot.  The list price was $720,000.  After 50 days on the market, it went under contract. Court confirmation was required. The final sale price was $720,000. It was an all-cash sale.
