The data collected from the Multiple Listing Service (“MLS”) consists of probate, trusts, and conservatorship sales.
These matters fall under the jurisdiction and responsibility of the Santa Clara County probate court. There is a legal process that must be followed when selling a probate home or real estate under a conservatorship.
Probate Home Sales Activity | July 2022
The Santa Clara County probate home sales include statistical data from July 1, 2022, through July 31, 2022, extracted from MLS Listings “MLS” as of August 1, 2022.
The data for July, August, and September includes single-family homes, planned unit developments (“PUDs”) which include condominiums, and townhouse-style homes and may not include “off-market” sales. An “off-market” sale is when the property is sold without listing on the Multiple Listing Service.
The breakdown of the July 2022 sales activity is as follows:
- 6 active listings
- 1 Conservatorship
- 5 Probate, 2 sold by the Public Guardian
- 5 single family homes
- 1 townhouse
- 9 pending sales (under contract)

The highest price home sold in July 2022 was in Los Altos 94022.
A two-story 3 bedroom, 3 bathroom, 2,114 square feet on an 8,414 sq. ft. lot. This home provided an opportunity to remodel or build a new modern home. It was listed in late May. After 16 days on the market, it went under contract. The list price was $2,998,000. The MLS reports there were 4 offers. The final sale price was $3,030,000. The buyer had conventional financing.
The lowest-priced home sold in July 2022 was in Cambrian Park San Jose 95124.
A 3 bedroom, 1 bathroom home, 1,108 square feet, on a 9,652 sq. ft. lot. The home needed a lot of work. MLS indicated unlivable in current condition. The list price was $899,000. After 12 days on the market, it went under contract. The final sale price was $1,112,000. It was a cash purchase.

The Santa Clara County probate home sales include statistical data from August 1, 2022, through August 31, 2022, extracted from MLS Listings “MLS” as of September 1, 2022.
The breakdown of the August 2022 sales activity is as follows:

- 2 townhouse
- 2 condominiums
- 5 pending sales (under contract)
- 5 probate – one being sold by the Public Guardian

- 6 probate – one sale required court confirmation

The highest price home sold in August 2022 was in Los Altos 94024.
A 3 bedroom, 2 bathroom, 1,508 square feet on a 9,391 sq. ft. lot. Marketed as a blank slate and a builder’s opportunity to knock down and start fresh. It was listed in March. After 10 days on the market, it went under contract. The sale was subject to court confirmation and the overbid process. The list price was $2,698,000. The MLS reports there were 12 offers. The buyer had private financing. The final sale price was $3,125,000.
The lowest-priced home sold in August 2022 was in the City of Gilroy 95020.
A 4 bedroom, 2 bathroom, 1,516 square feet, on a 6,500 square foot lot. The list price was $950,000. After 6 days on the market, it went under contract. The final sale price was $950,000. The buyer had conventional financing.

Our experience over the years tells us that public perception is that people can get screaming hot deals buying a probate home. In our experience in Santa Clara County, screaming hot deals buying a probate home is a myth. The sales data does not lie!
The lowest-priced home sold in September 2022 was in San Jose 95127.
A 3 bedroom, 1 bathroom, 900 square feet, on a 5,200 sq. ft. lot. The list price was $589,000. After 9 days on the market, it went under contract. The final sale price was $645,000. The MLS reports there were 8 offers. The buyer had conventional financing.
