This report provides an in-depth analysis of probate real estate activity in Santa Clara County for the first quarter of 2026. Compiled by Kathleen Daniels, an accomplished Independent Real Estate Broker who holds the Certified Probate Real Estate Specialist (CPRES) designation and certification in Professional Fiduciary Management for Trustees. The data herein is derived exclusively from the local Multiple Listing Service (MLS). Please note that this information does not include off-market transactions, which may not be captured in the MLS.

The probate division of the Santa Clara County Superior Court oversees both probate and conservatorship matters. Adhering to established legal protocols is essential for all parties involved in probate property transactions, ensuring compliance with court requirements and minimizing the risk of potential complications.


 

January 2026 Probate Real Estate Sales Activity

This report provides a focused analysis of probate residential real estate transactions in Santa Clara County, specifically single-family homes, planned unit developments (PUDs), condominiums, and townhouses during the period from January 1, 2026, through January 31, 2026. The data is sourced from MLS Listings as of February 1, 2026, and includes properties publicly listed on the MLS, thereby excluding any off-market sales. All probate properties in this review are subject to probate proceedings and, where applicable, may necessitate HOA disclosures.
The summary of sales for January 2026 is as follows:

Highest Priced Home Sale in January 2026
The highest-priced home sold in January 2026 was located in Santa Clara, 95051. This property features 3 bedrooms, 2 full bathrooms, 1,329 square feet of living space on a 5,940 square foot lot. It was listed in late November 2025 with a list price of $1,250,000. After 27 days on the market, the home went under contract, with the sale closing on January 9, 2026. The final sale price was $1,721,000. The MLS reports that 65 offers were received.

Lowest Priced Home Sale in January 2026
The lowest-priced home sold was in San Jose, 95117.  A 2-bedroom, 2-bathroom townhouse-style condominium home with a living space of 1,056 square feet. It was listed in mid-August 2025. The original list price was $999,888. After price reductions and 122 days, the home went under contract on December 13, 2025, and escrow closed on January 6, 2026.  The final sale price was $875,000. The purchase was with a VA loan.


 

Probate Sales Activity February 2026

Santa Clara County’s probate real estate transactions for February 2026 are summarized below. The following is an overview of probate sales for the period from February 1 to February 28, 2026, as of March 1, 2026.

Highest-Priced Home Sale in February 2026
The most expensive probate property in February 2026 was in Sunnyvale,  94085.  This home has three bedrooms and one bathroom, offering 1,171 square feet of living space on a 5,700 square-foot lot. Listed in early January, after 7 days on the market, the home was under contract. The list price was $1,400,000. The home sold for $1,710,000. Per MLS records, 13 offers were received. The buyer acquired the property with conventional financing.

Lowest Priced Home Sale in February 2026
The lowest-priced home sold was in Campbell, 95008.  A 1-bedroom, 1-bathroom condominium home with a living space of 704 square feet. It was listed in late December 2025. The list price was $450.000. After 42 days, the home went under contract. Escrow closed on February 24,  2026.  The final sale price was $432,000. MLS reports 2 offers were received. The purchase was all cash, no loans.

 


 

March 2026 Probate Real Estate Sales Activity

Santa Clara County’s probate sale statistics cover the period from March 1 through March 31, 2026, based on MLS Listings data compiled as of April 1, 2026. Below is a comprehensive breakdown of the sales activity for March.

Lowest-Priced Home Sale in March 2026
The lowest-priced sale was in San Jose, 95127. It was a single-family home with 3 bedrooms, 2 bathrooms, 1,559 square feet on a 7,000 square-foot lot. It was listed in early July 2025 at a list price of 875,000. After 63 days on the market, it went under contract. Escrow closed on March 6, 2026.  The final sales price was $808,000. The buyer had conventional financing.

Probate Real Estate

Highest-Priced Home Sale in December 2025
The most expensive probate property sale was in Cupertino, 95014. This property featured four bedrooms, three full bathrooms, 2,435 square feet of living space, on a 11,016 square foot lot. It was listed in early January at $2,795,000. The final sale price was $3,343,000. The buyer had conventional financing.
