Probate Home Sales in Santa Clara County Q-1 2023 Sales Activity Report by Kathleen Daniels, Certified Probate Real Estate Specialist (“CPRES) who monitors and tracks probate home sales on a monthly basis.

The data here is collected from the Multiple Listing Service (“MLS”).

probate home salesProbate and Conservatorship matters fall under the jurisdiction and responsibility of the Santa Clara County Superior Court, probate division.  There is a legal process that must be followed when selling probate homes or real estate under a conservatorship.

Probate Home Sales Activity January 2023

The Santa Clara County probate home sales include statistical data from January 1, 2023, through January 31, 2023, extracted from MLS Listings “MLS” as of February 1, 2023.

probate home sales, Probate is a legal processThe data for January, February, and March includes single-family homes, planned unit developments (“PUDs”) condominiums, and townhouse-style homes that may be probate property with HOA disclosure obligations and may not include “off-market” sales. An “off-market” sale is when the property is sold without listing on the Multiple Listing Service. Probate properties with HOA Disclosure Obligations.

The breakdown of the January 2023 sales activity is as follows:

The highest-priced home sold in January 2023 was in Palo Alto 94303.

A 3 bedroom, 1 bathroom, 1,368 square feet on a 6,757 sq. ft. lot.  It was listed in mid-November 2022. After 32 days on the market, it went under contract. The list price was $1,798,000.  The final sale price was $2,201,000. The MLS reports there were 12 offers. The buyer had no financing. The sale was all cash.

The lowest-priced home sold in January 2023 was in San Jose 95122.

A 3 bedroom, 1 bathroom, 1,379 square feet on a 5,400 sq. ft. lot. It was listed in early November 2022. The list price was $725,000. After 56 days on the market, it went under contract. The final sale price was $788,000. The home was marketed as a probate special. It was sold by the Public Guardian for Santa Clara County and the Conservator of the Person and Estate and did not require court approval, the highest bid won. The buyer had conventional financing.

The Santa Clara County probate home sales include statistical data from February 1, 2023, through February 28, 2023, extracted from MLS Listings “MLS” as of March 1, 2023.

Probate home sales subject to overbid process and court confirmationThe highest-priced home sold in February 2023 was in Saratoga 95070.

A  3 bedroom, 2.5 bathroom, 2,148 square feet on a 13,500 sq. ft. lot. It was listed in early January 2023. After 5 days on the market, it went under contract. The list price was $2,950,000.  The final sale price was $3,100,000. The MLS reported that 2 offers were received. The buyer had conventional financing.

The lowest-priced home sold in February 2023 was a condo in San Jose 95116.

A 2 bedroom, 2 bathroom, 849 square feet. The list price was $599,975. After 95 days on the market, it went under contract. The final sale price was $575,000. The buyer had conventional financing.


Probate Home Sales Activity March 2023

The Santa Clara County probate home sales include statistical data from March 1, 2023, through March 31, 2023, extracted from MLS Listings “MLS” as of April 1, 2023.

The highest price home sold in March 2023 was in San Jose 95125.

A  2 bedroom, 2 bathroom, 1,206 square feet on a 6,518 sq. ft. lot. The list price was $749,000.  After 6 days on the market, it went under contract. The final sale price was $925,000. The buyer had conventional financing.

The lowest-priced home sold in March 2023 was in San Jose 95112.

A 2 bedroom, 1 bathroom, 1,081 square feet on a 4,629 sq. ft. lot.  The list price was $690,000. The price was reduced to $524,999. After 62 days on the market, it went under contract. The final sale price was $525,000. The buyer had no financing. It was a cash sale.
