Probate and Conservatorship matters fall under the jurisdiction of the Santa Clara County Superior Court, probate division.  A legal process must be followed when selling a house in probate or buying a probate house.


 

Probate Real Estate Sale Activity July 2024

The probate sale activity in Santa Clara County includes statistical data from July 1, 2024, through July 31, 2024, extracted from MLS Listings “MLS” as of August 1, 2024.

The data for July, August, and September include single-family homes, planned unit developments (“PUDs”) condominiums, and townhouse-style homes that may be probate property with HOA disclosure obligations and may not include “off-market” sales. An “off-market” sale is typically when the property is sold without listing on the Multiple Listing Service.

The breakdown of the July 2024 sales activity is as follows:

  •  4 active listings
    • 4 probate homes
    • 2 single-family homes
    • 1 townhouse
    • 1 condominium
  • 6 pending sales (under contract)
    • 5 probate
    • 1 selling in a living trust after death
    • 6 single-family homes
  • 2 sold homes
    • 2 probate
    • 2 single family

Probate real estate, Many probate homes sell at premium prices

The highest-priced home sold in July 2024 was in San Jose 95125

A 3 bedroom, 2 bathroom, 1,542 square feet on a nearly 7,000 sq. ft. lot.  It was listed in late April 2024. The list price was $1,600,000.  After 37 days on the market, it went under contract. The sale closed in mid-July. The final sale price was $1,710,000.  The home was listed by the Santa Clara County Public Guardian, subject to court approval, and overbid process.

The lowest-priced home sold in July 2024 was in San Jose 95127.

A 4 bedroom, 2 bathroom, 1,634 square feet on a 7,650 sq. ft. lot.  It was listed in late May. The list price was $1,125,000. After 13 days on the market, it went under contract. The final sale price was $1,230,000.  The buyer had conventional financing. MLS reports two offers were received.

 


 

Probate Sale Activity August 2024

The probate sale activity in Santa Clara County includes statistical data from August 1, 2024, through August  31, 2024, extracted from MLS Listings “MLS” as of September 1, 2024.

The breakdown of the August 2024 sales activity is as follows:

  •  8 active listings
    • 8 probate houses for sale
    • 7 single family homes
    • 1 condominium
  • 8 pending sales (under contract)
    • 7 probate
    • 1 sold in a living trust after death
    • 5 single family homes
    • 2 townhouse
    • 1 condominium
  • 3 sold homes
    • 3 probate
    • 3 single family

Probate real estate, some home sales may be subject to the overbid process and court confirmationThe highest-priced home sold in August 2024 was in  Santa Clara 95051.

A  4 bedroom, 2 bathroom, 1,232 square feet on a 7,000 sq. ft. lot. It was listed in early early August. It went under contract the same day it was listed. The list price was $2,185,000.  The final sale price was $2,500,000. There were three offers. It was a cash sale.

The lowest-priced home sold in August 2024 was in San Jose 95126.

A 2 bedroom, 1 bathroom, 1,076 square feet on a 4,000 sq. ft. lot. It was listed in early to mid-July 2024. The list price was $875,000. The list price reflected the “not in the best condition” of the home.  After 6 days on the market, it went under contract. The final sale price was $1,050,000.  Seven offers were received. The buyer had conventional financing.

The probate sale activity in Santa Clara County includes statistical data from September 1, 2024, through September 30, 2024, extracted from MLS Listings “MLS” as of October 1, 2024.

The breakdown of the September 2024 sales activity is as follows:

A 3 bedroom, 2 bathroom, 1,136 square feet townhouse. The list price was $1,498,000.  After 8 days on the market, it went under contract. The final sale price was $1,688,500. The buyer had conventional financing.

The lowest-priced home sold in September 2024 was in San Jose 95135.

A 2 bedroom, 2 bathroom, 1,265 square feet condominium. The list price was $728,000.  After 96 days on the market, it went under contract. The final sale price was $691,000. The buyer had conventional financing.
