Probate and Conservatorship matters fall under the jurisdiction of the Santa Clara County Superior Court, probate division.  A legal process must be followed when selling a house in probate or buying a probate house.


 

Probate Real Estate Sale Activity October 2024

The probate sale activity in Santa Clara County includes statistical data from October 1, 2024, through October 31, 2024, extracted from MLS Listings “MLS” as of November 1, 2024.

The data for October, November, and December include single-family homes, planned unit developments (“PUDs”) condominiums, and townhouse-style homes that may be probate property with HOA disclosure obligations and may not include “off-market” sales. An “off-market” sale is typically when the property is sold without listing on the Multiple Listing Service.

The breakdown of the October 2024 sales activity is as follows:

The highest-priced home sold in October 2024 was in San Jose 95128

A 4 bedroom, 2.5 bathrooms, 2,308 square feet on a 8,276 sq. ft. lot.  It was listed in late July 2024. The list price was $1,800,000.  After 34 days on the market, it went under contract. The sale closed in late October. The final sale price was $1,900,000. The home was marketed as a “Fixer” and “Contractor Special”. The sale required Court confirmation and was subject to the over-bid process. The MLS reports that 9 offers were received. The purchase was all cash – no loans.

The lowest-priced home sold in October 2024 was in San Jose 95130.

A 2 bedroom, 2.5 bathrooms, 1,105 square feet. It was listed in early August. The list price was $729,000. After 14 days on the market, it went under contract. The final sale price was $680,000.  The buyer had conventional financing.

 


 

Probate Sale Activity November 2024

The probate sale activity in Santa Clara County includes statistical data from November 1, 2024, through November 30, 2024, extracted from MLS Listings “MLS” as of December 1, 2024.

The breakdown of the November 2024 sales activity is as follows:

Probate real estate, some home sales may be subject to the overbid process and court confirmationThe highest-priced home sold in November 2024 was in  Palo Alto 94301.

A  3 bedroom, 2 bathroom, 1,400 square feet on a 5,663 sq. ft. lot. It was listed in late August. After 35 days on the market, it went under contract in early October. The list price was $2,500,000.  The final sale price was $3,052,000. The buyer had conventional financing.

The lowest-priced home sold in August 2024 was in San Jose 95118.

A 4 bedroom, 2 bathroom, 1,376 square feet on a 6,970 sq. ft. lot. It was listed in late August. The list price was $1,485,000.  The price was reduced to $1,395,000. After 39 days on the market, it went under contract. The final sale price was $1,310,000.  Seven offers were received. It was a cash purchase – no loans.

The probate sale activity in Santa Clara County includes statistical data from December 1, 2024, through December 31, 2024, extracted from MLS Listings “MLS” as of January 1, 2025.

The breakdown of the December 2024 sales activity is as follows:

A 4 bedroom, 2 bathroom, 1,672 square feet on a 10,976 sq. ft. lot. The list price was $1599,000.  After 12 days on the market, it went under contract. The final sale price was $1,800,000. The buyer had conventional financing.

The lowest-priced home sold in December 2024 was in San Jose 95127.

A 2 bedroom, 1 bathroom, 828 square feet condominium. The list price was $400,000.  After 18 days on the market, it went under contract. The home was water-damaged, sold “as-is” and assumed tenancy. The final sale price was $300,000. The sale was all cash – no loans.
