Certified Probate Real Estate Specialist
What is a probate specialist? One Size does not fit all when it comes to probate education. We live in a highly specialized world. Obtaining probate realtor training does not make one an “expert” in probate real estate sales. A personal representative of an estate (Executor or Administrator) has a fiduciary duty to act with a high standard of care. We can boil that down to mean exercising prudence in who they hire to manage the sale of real estate.
Specialization goes beyond obtaining a certification. Probate is managed differently from state to state. Obtaining certification as a probate real estate specialist does not teach the student about the state contracts, the laws that govern the probate code, the probate process at the state level, or the local rules at the county level – the court where the probate estate is administered.
It is up to the student/real estate agent to learn the contracts, understand the process, and continue to learn and expand their knowledge of how a particular probate sale progress. Will it require court approval? Does the estate representative have full authority under the Independent Administration of Estates Act (“IAEA”) and if so, what does that mean? What does it mean if they don’t?
Many of the attorneys I work with express their frustration with the real estate agents their clients hire. Managing a probate estate is not the time to hire your neighbor or best friend who happens to be a real estate agent.

Probate Real Estate Services
In my experience, most people managing a probate estate do not know or care how important it is to hire a real estate agent that truly understands the probate process. Again, this goes back to the estate representative’s fiduciary duty to the estate – to act with a high standard of care – with prudence.
When selling one’s own property we can be as irresponsible as we want. After all, it’s our property!
However, when acting on behalf of an estate, we become officers of the court, so to speak, and there is an expectation that the estate representative acts responsibly.
We track the probate sales in Santa Clara County and publish monthly market data reports. In reviewing the MLS data, we see far too many real estate agents entering a probate listing as a regular sale. We do not have access to the contracts their clients signed yet IF the proper contracts get signed the presumption is that the corresponding data would be entered into the MLS.
We frequently see the listing period on a probate sale be for 6, 9, and 12 months. Is this due to a lack of knowledge and experience or is it a matter of don’t care and the client won’t know the difference anyway?
When a probate listing is entered into a Probate Listing Addendum and Advisory must also be included with the listing agreement. Item No. 2 on the Probate Listing Addendum and Advisory states:
“The Listing Period shall be the shorter of 90 Days or the length of time specified in the Listing.”
A 90-day listing period rule applies to all probate listing agreements including when the representative has full authority under IAEA. Read more about selling probate homes in California.
California Probate Code 10150(c) states, in part, the listing period may not exceed ninety days. Extensions of up to ninety days each may be granted if needed.
We are not attorneys however we do understand that the code means it is a law. If the agent a personal representative hires are not following the law, what else do you suppose they might be doing that could potentially cause harm? If put to the exercising prudence test, do you think it would pass?
