Executor Hired Probate Realtor to List a Probate Home

The executor of an estate hired a Probate Realtor, Kathleen Daniels to list this Probate Home. The home was listed on October 10, 2022.  An offer deadline was set. After nine (9) days on the market, the executor accepted an offer.

 

 

The level of showing activity on this Sunnyvale home was high.  Within 30 minutes of listing the home on the Multiple Listing Service (“MLS”), the phones started to ring. 

This is a move-in-ready home in a desirable Sunnyvale location. It offers a great opportunity as a starter home for a first-time homebuyer and has room for expansion.

  • 1 Bathroom
  • 894 Square Feet of Living Space
  • 5,311 Square Feet Lot Size 

The home was built in 1950. The owner had passed away. After 25 years of owning the home, the executor of the estate, who resided out of state, contacted Kathleen Daniels to list the home.

The bathroom was remodeled with permits in 2016. The balance of the home needed some work. It is not uncommon for an executor to not have funds to improve a home before selling it.  That was not the case here. The executor decided to have some work done on the home before it was listed.

Details of the Sale: 

  1. Listed on October 10, 2022
  2. List Price $1,200,000
  3. Five (5) offers were received
  4. The executor accepted an offer on October 19, 2022
  5. Escrow closed on schedule on November 18, 2022
  6. Sale Price $1,225,000
  7. The buyer had conventional financing

What does it mean to be an executor of a will?

Generally speaking, it means that the creator of a will, named a person in their will to manage their estate when they die.

Probate is a legal process supervised by the probate court.  At the hearing to petition for probate, the judge issues the person petitioning the court to administer an estate, Letters Testamentary (“Letters”). The petitioner does not have the authority to act on behalf of the estate until the judge issues the Letters. 

 

What is the role of the executor of a will?

Fiduciary Duties of a Successor TrusteeAn executor has fiduciary duties to the heirs and the estate. The role is to fulfill all executor duties.  The duties are many. Among them may be to sell a home.  Before we list a home we require a certified copy of the Letters to verify the executor has the authority from the court to sell the home.

When an agent positions themselves as a probate expert and they have never listed or sold a probate home, Kathleen believes is deceitful and deceptive.  That is why she strongly recommends that an estate representative should vet a probate realtor before hiring. 

What a real estate agent brings to the table before we do something for the first time is a huge factor to consider. 

Kathleen Daniels experience, education, and extensive training set her apart in the industry.  She is a member of the Silicon Valley Bar Association and attends all probate judges’ updates to keep current with the court.  She attends all legal update classes provided by the local board.
