What does it mean to be an executor of a will?
Generally speaking, it means that the creator of a will, named a person in their will to manage their estate when they die.
Probate is a legal process supervised by the probate court. At the hearing to petition for probate, the judge issues the person petitioning the court to administer an estate, Letters Testamentary (“Letters”). The petitioner does not have the authority to act on behalf of the estate until the judge issues the Letters.
What is the role of the executor of a will?
An executor has fiduciary duties to the heirs and the estate. The role is to fulfill all executor duties. The duties are many. Among them may be to sell a home. Before we list a home we require a certified copy of the Letters to verify the executor has the authority from the court to sell the home.
