Probate Real Estate for Sale. The Administrator of the estate hired an Independent real estate broker and Certified Probate Real Estate Specialist, Kathleen Daniels, to manage the sale of the probate property. Kathleen was contacted in mid-January 2025 by a family member of the deceased who was unable to find a probate attorney willing to probate the estate because the value was below a certain threshold.
Under California Probate Code Section 10800, statutory probate fees refer to the legal fees paid to both the executor (or administrator) and the attorney for managing a deceased person’s estate through the probate process. These fees are set by California law and are calculated as a percentage of the appraised value of the estate, not including debts or mortgages. The statutory schedule starts at 4% of the first $100,000, 3% of the next $100,000, 2% of the next $800,000, and so on, with the percentage decreasing for larger estates. Both the executor and the attorney are entitled to collect these fees, which are intended to compensate them for their services during probate. Additional fees may be requested for extraordinary services, subject to court approval.
