Probate and Conservatorship matters fall under the jurisdiction of the Santa Clara County Superior Court, probate division.  A legal process must be followed when selling a house in probate or buying a probate house.


 

Probate Real Estate Sale Activity April 2024

The probate sale activity in Santa Clara County includes statistical data from April 1, 2024, through April 30, 2024, extracted from MLS Listings “MLS” as of May 1, 2024.

The data for April, May, and June include single-family homes, planned unit developments (“PUDs”) condominiums, and townhouse-style homes that may be probate property with HOA disclosure obligations and may not include “off-market” sales. An “off-market” sale is typically when the property is sold without listing on the Multiple Listing Service.

The breakdown of the April 2024 sales activity is as follows:

  •  4 active listings
    • 3 probate homes
    • 1 selling property held in living trust after death
    • 3 single family homes
    • 1 condominiums
  • 7 pending sales (under contract)
    • 5 probate
    • 2 selling in a living trust after death

Probate real estate, Many probate homes sell at premium prices

The highest-priced home sold in April 2024 was in San Jose 95117

A 3 bedroom, 2 bathroom, 1,437 square feet on a 5,663 sq. ft. lot.  It was listed in early February 2024. The original list price was $1,300,000.  After six days on the market, the list price was increased to $1,575,000. A week later, it went under contract. The sale closed in mid-April. The final sale price was $2,020,000.  MLS reports seven (7) offers were received. The buyer had conventional financing.

The lowest-priced home sold in April 2024 was in San Jose 95135.

A 2 bedroom, 2 bathroom, 1,804 square feet condominium. It was listed in early January. The original list price was $988,000. After 40+ days on the market, it went under contract. The final sale price was $938,000.  The buyer had conventional financing.

 


 

Probate Sale Activity May 2024

The probate sale activity in Santa Clara County includes statistical data from May 1, 2024, through May 31, 2024, extracted from MLS Listings “MLS” as of June 1, 2024.

The breakdown of the May 2024 sales activity is as follows:

  •  8 active listings
    • 8 probate houses for sale
    • 6 single family homes
    • 2 condominiums
  • 6 pending sales (under contract)
    • 4 probate
    • 2 selling property held in living trust after death
    • 6 single family homes
  • 4 sold homes
    • 3 probate
    • 1 sold in a living trust after death
    • 2 single family
    • 1 condominiums
    • 1 Townhouse

Probate real estate, some home sales may be subject to the overbid process and court confirmationThe highest-priced home sold in May 2024 was in  Santa Clara 95050.

A  4 bedroom, 3 bathroom, 2.383 square feet on a 10,000+ sq. ft. lot. It was listed in early early April. After 11 days on the market, it went under contract. The list price was $2,699,000.  The final sale price was $2,852,,000. The buyer had conventional financing.

The lowest-priced home sold in May 2024 was in San Jose 95135.

A 2 bedroom, 3 bathroom, 1,751 square feet condominium. It was listed in early mid-January 2024. The original list price was $1,024,999. The price was reduced to $969,000. After nearly 90 days on the market, it went under contract. The final sale price was $970,000. The buyer had conventional financing.

 


 

Probate Real Estate Sale Activity June 2024

The probate sale activity in Santa Clara County includes statistical data from June 1, 2024, through June 30, 2024, extracted from MLS Listings “MLS” as of July  1, 2024.

The breakdown of the June 2024 sales activity is as follows:

  •   5 active listings
    • 4 probate
    • 1 selling property held in living trust after death
    • 2 single-family home
    • 2 condominiums
    • 1 Townhouse
  • 3 pending sales (under contract)
    • 3 probate
    • 3 single family homes
  • 8 sold homes
    • 6 probate

    • 8 single family homes

Two homes in trust were sold through the Santa Clara County Public Guardian | Public Administrator

One home sold by the Successor Trustee of their parent’s trust was not reported in the monthly statistics because, given how the trust was administered, it was not subject to court approval.  Kathleen Daniels listed the home.  The list price was $1,600,000.  Eight (8) offers were received.  The final sales price was $1,815,000. A 2 bedroom, 1 bathroom, 1,100  square feet on a 12,000+ square foot lot. The list price was $1,640,000.  After 13 days on the market, it went under contract. The final sale price was $2,400,000. The buyer had conventional financing.

The lowest-priced home sold in June 2024 was in San Jose 95127.

A 4 bedroom, 2 bathroom, 1,154 square feet on a 7,000 square foot lot. The list price was $750,000.  After 17 days on the market, it went under contract. The final sale price was $800,000. The MLS reports that 15 offers were received.  It was an all-cash sale – no financing.
